Ellis Act


AB 982 (Bloom and Chiu)

AB 982 would make significant changes to the Ellis Act, which provides a process for landlords who wish to take rental properties off the market.  Current law allows local governments to require that landlords give certain notice of their intent to remove their units from the rental market, in addition to any notice required by law or under the rental agreement. For most units, the required notice is 120 days.  For units occupied by tenants aged 62 and over or who have a disability, and have occupied the unit for one year or longer, the landlord is required to give one year’s notice of their intent to take the unit off the rental market.  AB 982 would require one year’s notice anytime a landlord wants to get out of the rental housing business.
